Kisoro grade one magistrate convicts two men over robbery

 


The Kisoro grade one court Magistrate led by his worship Raphael Vueni  on Thursday 20th convicted two men in their 30’s with charges of simple robbery for stealing over 17 million shillings from a business woman at Chapa trading center in Nyakabande Sub County.

According to court records, the  offense committed in 2016.


The convicts are Munyagabe Amos Pius aged 32 and Ngabirano Levikato aged 34 all residents of Bubaga village Gisorora parish in Nyakabande Sub County.


According to prosecution, on 29th September 2016 the convicts jointly committed the crime contrary to sections 285 and 286 sub section 1(a) of the penal code act by attacking a one Mukarusasa in her mixed bar and shop.


Prosecution adds that the two men who were his usual clients violently robbed her airtime cards worth 9,884,000 shillings, a mobile phone worth 65,000 shillings and hard cash once 8,000,000 shillings.


According to Mukarusasa’s statement in court, on the fateful day, Munyagabe Amos visited his shop and asked for a Sacket of chief Waragi but she was surprised to be caught by the same customer joined with Ngabirano. She adds that the two men covered her mouth with Kitenge, pushed her into the counter, and tied her arms and legs before robbing her.


In his ruling, his worship Raphael Vueni said that the convicts denied committing the crime and were allowed to defend themselves but their witnesses gave controversial testimonies before court while the prosecution gathered enough evidence to prove that the convicts indeed did the crime.


He also revealed that robbery charges are contrary to section 286 sub section 1 (a) of the penal code act and attracts a maximum sentence of 10 years in the magistrate’s court.


The convicts were remanded to Kisoro prison until 27th October when they will appear for sentence.
